Personal Data Privacy Notice to Job Applicants for TH Group of Companies

1. General

This document serves as both a consent and a declaration form under the Personal Data Protection Act 2010 (“The Act”). It outlines how TH Group ofCompanies (TH) is committed to ensure that your personal data is processed in accordance with the Act. In this respect this Privacy Notice serves to inform you on how we handle potential candidates’ personal data that we collect, process and store in TH.

We will process your personal data (including your sensitive personal data such as information about your physical or mental health condition, religious belief and criminal conviction, if applicable, and other information we may obtain about you from third parties) in order to process your application for employment in accordance with our criteria toliaise with you.

The entire employment process may entail the supply of further information, and we may obtain the relevant information from third parties(including without limitation, information from your public records, background check agencies, past employers, referees) regarding the qualifications, experience, suitability and/ or other relevant information foremployment related purposes. All the information obtained will be kept strictly confidential and utilised only for assessing your application.

2. Purpose of Personal Data Collection

  • Identification details (e.g., NRIC/Passport number)

  • Financial information (e.g., salary details)

4. Consent for Data Collection and Processing

By signing this form, you hereby give your consent for Talent Houz to:

  • The collection, use, processing, and storage of your personal data for the purposes outlined above.
  • Sharing of your personal data with third-party entities, such as potentialemployers, background screening agencies, reference checkers, and relevant regulatory bodies, where necessary.
  • Conducting reference checks using the referees you have provided.
  • For our internal administrative purposes including historical and conflict checking purposes.
  • Liaising with you
  • Forming a talent database

5. Disclosure

You hereby consent and authorise us to disclose or transfer your personal data (within or outside Malaysia) for the purposes stated above to the following:

  • Third party service providers for the purposes of performing reference checks, background screening, bankruptcy searches, criminal records etc.
  • Potential employers’ appointed medical practitioner(s)
  • Statutory bodies such as Employee Provident Fund, Social Security Organisation, Human Resource Development Fund etc.
  • Professional advisors including lawyers, accountants, auditors and insurers on a need to know basis for the purposes of providing their services or advices to us.
  • Any necessary third party service providers acting on our behalf or appointed by us to act on our behalf for purposes of performing a contract of employment.

6. Security of Personal Data

We are committed to ensuring that your personal data is stored securely.

7. Your Rights and Obligations regarding Your Personal Data

  • We take it that all personal data provided by you is accurate and complete, and that one of it is misleading or out of date. You will promptly update us in the event of any change to your personal data.
  • To the extent that you have provided (or will provide) personal data about your family members, spouse and/ or other dependents, you confirm that you have explained to them that their personal data will be provided to, and processed by, us and you represent and warrant that youhave obtained their consent to the processing (including disclosure and transfer) of their personal data in accordance with this Privacy Notice.
  • In respect of minors (i.e. individuals under 18 years of age) or individuals not legally competent to give consent, on their behalf to the processing (including disclosure and transfer) or their personal data in accordance with this Privacy Notice.
  • To the extent that the applicable law allows, you have the right to request for access to, request for a copy of, request to update or correct, your personal data held by us. Notwithstanding the foregoing, we reserve our rights to rely on any statutory exemptions and/ or exceptions to collect, use and disclose your personal data.

8. Amendments to the Policy

We may update or amend this PDPA Consent Form from time to time. Any changes will be communicated to you through the appropriate channels.
